and Conditions
The following are the terms
and conditions of participation in the ProPaid Email Program. "Member"
refers to yourself, and "ProPaidEmail.com" refers to us, ProPaidEmail.com.
Acknowledgement and Acceptance
By enrolling and/or using the ProPaidEmail Program ("ProPaidEmail"),
you agree that you have read and understand this Agreement ("Agreement")
and that your membership in ProPaid Email shall conform to its terms
and conditions.
ProPaidEmail.com reserves the right to limit ProPaidEmail enrollment
at any time. All Member applications are subject to approval by ProPaidEmail.com.
ProPaidEmail.com may deny membership to any person, with or without
cause.
ProPaidEmail Program ("Program") members ("Members") may earn money
("Money") for enrolling in the Program; and by taking advantage of Money-earning
opportunites through the Program.
Terms of Participation
Only individuals 18 years or older, or individuals age 13 years to
17 years that have obtained parental permission, may enroll in ProPaidEmail
and become Members. Residents of Japan must be 20 years of age or older.
ProPaidEmail.com allows only one account per household and/or person
and/or email address and/or IP address. All accounts found in violation
will be terminated without notice and all unpaid Money will be terminated
and cancelled. An individual person may sign up only once.
ProPaidEmail.com allows only one email address per Member.
ProPaidEmail membership and its right to use is limited to one individual
per ProPaidEmail account.
Member agrees to provide only true and accurate information to ProPaidEmail,
it advertisers, and its partners at all times.
Member agrees not to abuse ProPaidEmail privileges by conduct which
is detrimental to the interests of ProPaidEmail.com, including without
limitation attempting to accrue Money or spend Money through illegitimate
channels, or in a manner inconsistent with this Agreement or the intent
of this Agreement
Member agrees not to tamper with links in email messages from ProPaidEmail.com.
Member agrees that Paid Email messages shall be considered Transactional
or Relationship messages under the CAN-SPAM Act of 2003.
Member agrees not to any ProPaidEmail in a public forum. Emails sent
to the ProPaidEmail membership are for ProPaidEmail members only. Any
member of ProPaidEmail who posts emails from ProPaidEmail in a public
forum will have their ProPaidEmail account terminated and all monies
in said account will be forfeited.
Member agrees not to forward any ProPaidEmail email message to others
without first obtaining the expressed written permission of ProPaidEmail.
Email messages are specific to Member's membership unless otherwise
stated.
Member agrees not to use profane language or threats in communications
with ProPaidEmail.com staff.
Member agrees not to send unsolicited emails, newsgroup postings,
chat room posting, message board postings or Usenet messages (collectively
"Spam") except when mailing to appropriate opt-in mailing lists where
the source does the mailing on Member's behalf. If Member is deemed
to have been guilty of Spam, Member's account will be terminated and
all unpaid Money will be terminated and cancelled. Any service interruptions
as a result of Member Spam will be billed to Member at $100.00 per hour
until service is restored.
ProPaidEmail.com shall be the sole determiner in cases of suspected
abuse, fraud, or violation of its rules.
Member agrees that any decision ProPaidEmail.com makes relating to
termination of membership shall be final and binding.
Member must click appropriate web site link in paid emails to earn
credit for reading the email advertisement.
Member may receive up to 50 paid emails per day from ProPaidEmail.com.
Money may be redeemed only in ways as offered through ProPaidEmail
at the time of redemption.
Member must earn $225.00 United States dollars with $50 in self earnings
prior to requesting payment.
Also, now that we have a toolbar that earns you up to 20c
per offer with hundreds of offers available at all times,
you may request payment for your toolbar earnings seperately!
If you have over $10 in toolbar earnings you can submit a request
at the beggining of every month to be paid. This allows you
to make money while working towards the big ProPaidEmail payout :)
You need to be active in reading emails, and paid to searching to
do this.
Member shall be paid by Simple-Cents, Moneybookers, Alertpay, Stormpay,
IntGold or Egold.
Member must confirm or activate Member's account prior to requesting
payment.
ProPaidEmail reserves the right to limit the redemption of Money.
ProPaidEmail will be subtracted from Member's account once Money is
redeemed for payment or advertising.
Once requested to be converted into monetary payment, Money will not
be reinstated to Member's account.
Although the Program is not limited to citizens of the United States
of America, all payments will be made in U.S. dollars.
ProPaidEmail.com will manage and track all referrals under this Program
and shall be the sole determiner in any disputes regarding referrals.
Member will be paid 5% of their referrals' earnings for 10 levels
of referrals.
Member must click on at least 5% of all links in paid emails to be
eligible for referral earnings.
Member will not be eligible for referral earnings if they haven't
clicked a paid link in the previous five days.
Member's account will be terminated if less than 10% of Member's referrals
have confirmed or activated their email address within 14 days of their
registration.
Webmasters of other Paid Email websites that scam their members may
have their account frozen by ProPaidEmail. Unpaid funds will then be
paid to members of ProPaidEmail that have been scammed by that particular
webmaster.
ProPaidEmail.com reserves the right to send Members email messages
from time to time for which they may not be rewarded ("Unrewarded Messages").
ProPaidEmail.com is under no obligation to provide Members with any
particular number of Money-earning opportunites or send messages to
them.
Member's discontinued participation in ProPaidEmail or failure to
notify ProPaidEmail.com of any email address change may result in the
termination of Member's membership and forfeiture of Member's unredeemed
Money.
ProPaidEmail.com reserves the right to cancel or disable any membership
if that Member has not approriately responded to an email for a period
of 30 days. Member will forfeit Member's unredeemed Money.
ProPaidEmail.com reserves the right to cancel or disable any membership
if that Member has not earned any Money for a period of 30 days.
ProPaidEmail.com reserves the right to cancel the account of members
who use autoresponders for the email in which you receive ProPaidEmail.com
emails. AutoResponders are not allowed!
ProPaidEmail reserves the right to terminate any account that bounces
email.
Member may not misrepresent ProPaidEmail.com in any way.
Member may not advertise ProPaidEmail.com products and/or services
or display a link to ProPaidEmail.com of any kind on the following sites:
Sites that promote sexually explicit material, viloence, or hate, sites
that promote discrimination based on race, sex, religion, national origin,
or physical disability, sites that promote illegal activies, or any
other site deemed inappropriate by ProPaidEmail.com in its sole discretion.
Member agrees that Member is not an employee of ProPaidEmail.com and
is responsible for their own local, state, country, and/or all other
applicable taxes. ProPaidEmail.com reserves the right to withhold applicable
taxes where required by law.
Member's correspondence with or participation in promotions of ProPaidEmail
advertisers and/or partners are solely between corresponding Member
and the advertiser of partner. ProPaidEmail.com assumes no liability,
obligation, or responsibility for any part of any such correspondence
or promotion.
Member shall comply with all laws, rules, and regulations that are
applicable to Member. Member acknowledges that Member may only participate
in ProPaidEmail if and to the extent that such participation is permitted
by such laws, rules, and regulations. ProPaidEmail.com reserves the
right or terminate Member's participation in ProPaidEmail, without liability
to Member or any other party, if Member violates any law, rule, or regulation,
or if Member's participation in ProPaidEmail could violate any law,
rule, or regulation.
Privacy
ProPaidEmail.com will attempt to maintain the privacy of Members'
personal information. Please see our Privacy page for more information.
ProPaidEmail.com collects your email address and may collect other
information to you. ProPaidEmail.com may place cookies on your computer.
Legal Compliance
ProPaidEmail.com will cooperate with law enforcement where required
by law. This may include releasing information about Member or Members.
Non-Transferability
Money is non-transferable and are void if transferred.
ProPaidEmail accounts are non-transferable.
Member's right to use ProPaidEmail is non-transferable.
Termination
ProPaidEmail's membership will be terminated immediately in the event
of ProPaidEmail's death.
ProPaidEmail.com reserves the right to terminate or disable, at ProPaidEmail.com's
sole discretion, any ProPaidEmail membership if ProPaidEmail.com believes
such Member has violated or acted inconsistently with the rules of ProPaidEmail
or the intent of this Agreement. Member understands and agrees that
disabling of membership will result in Member's inability to redeem
and/or earn Money. Member understands and agrees termintation of membership
will result in cancellation of all Member's Money.
At any time either Member or ProPaidEmail.com may terminate membership
with or without cause. Member's right to use Member's membership immediately
ceases upon termination and Member's unredeemed Money shall be cancelled
and forfeited. ProPaidEmail.com reserves the right to terminate the
membership of any Member at any time without prior or written notification.
Termination of Member's membership by Member is effective upon Member
submitting a Cancel Account Request through the ProPaidEmail web site
by following the directions in the Member Area on the ProPaidEmail web
site, Member properly completing and submitting the appropriate form
and Member receiving a message from ProPaidEmail confirming termination.
Member may receive email messages after termination. It is Member's
responsibility to unsubscribe from all ProPaidEmail mailing lists.
At any time, if Member does not agree with this Agreement, Member
must terminate Member's membership.
Should Member object to any of the terms and conditions of this Agreement,
or any subsequent modifications of this Agreement, or become dissatisfied
with ProPaidEmail, Member's only recourse is to immediately discontinue
participation in ProPaidEmail and terminate Member's membership.
Disclaimer of Warranties
Member expressly agrees that use of ProPaidEmail is at the Member's
sole risk.
ProPaidEmail and all services offered therin are provided on a strictly
"as is" and "as available" basis. ProPaidEmail.com makes no warranty
with regard to any product, services, or rewards obtained by Members
through ProPaidEmail or through ProPaidEmail advertisers of partners;
or that ProPaidEmail will meet Members' requirements.
ProPaidEmail.com makes no warranty or guarantees as to the results
that may be obtained from the use of ProPaidEmail or as to the accuracy
or reliability of any information obtained through ProPaidEmail.
ProPaidEmail.com expressly disclaims any and all expressed and implied
warranties. ProPaidEmail.com shall not be liable or responsible for
those guarantees, warranties, and representations, if any, offered by
ProPaidEmail advertisers, partners, manufacturers of merchandise, or
suppliers of services. No advice or information obtained by Member shall
create any warranty not expressly made in this Agreement.
Limitations of Liability
ProPaidEmail.com shall not be liable and shall not be held liable
for any direct, indirect, special, consequential, or incidental damages
or any loss of revenue of profits arising under or with respect to this
Agreement or Program, or relating to the participation or inability
to participate in ProPaidEmail. Some states do not allow the limitation
of liability, so the above limitation may not apply to you.
ProPaidEmail.com is not responsible for damages or losses that result
from the participation or inability to participate in ProPaidEmail,
or reliance on or use of information or services provided on, by, or
through ProPaidEmail.
Member acknowledges and agrees that ProPaidEmail.com neither endorses
the contents of advertisements or advertiser's websites, nor assumes
responsibility or liability for material contained in advertiser's websites.
Member agrees that ProPaidEmail.com is not responsible and assumes
no liablity for changes from advertisers or sponsors which may affect
the accrual of Money.
Member understands that Member tracking can never be 100% accurate
and agrees that ProPaidEmail.com is not responsible for inaccuracies
that might occer in Member tracking.
In no event shall ProPaidEmail.com's liability, either jointly or
severally, exceed $50.
Indemnification
Member agrees to indemnify and hold ProPaidEmail.com, its affiliates,
partners, officers, and employees harmless from any claim, demand, expense,
or damage, relating to the use of ProPaidEmail or violation of this
Agreement.
Propriety Rights to Content
Member acknowledges that ProPaidEmail content, service, services
and/or software are property of ProPaidEmail.com. Member is only permitted
to use content, service, services, and/or software as expressly authorized
by ProPaidEmail.com. Member may not display a ProPaidEmail.com logo
or image which may be distasteful, defame, or misrepresent.
Modifications
ProPaidEmail.com reserves the right to change this Agreement, and/or
any part of this Agreement, at any time. Member understands that the
most recent version of this Agreement will be located on the ProPaidEmail
web site.
Member's non-termintation and/or continued use of ProPaidEmail constitutes
an affirmative acknowledgement of any modification to the this Agreement
and agrees to abide and be bound by any terms of this Agreement and/or
any modifications of this Agreement.
ProPaidEmail.com reserves the right to modify or discontinue the ProPaidEmail
service at any time with or without notice to Member.
ProPaidEmail.com shall not be liable to any Member or other party
should ProPaidEmail.com modify or discontinue the ProPaidEmail service.
Laws
Member agrees that, any provision of applicable law notwithstanding,
Member will not request, and the arbitrators shall have no authority
to award, punitive or exemplary damages against ProPaidEmail.com.
This Agreement constitutes the complete and exclusive understanding
between ProPaidEmail.com and Member and supersedes all prior understandings,
agreements, communications, and/or advertising.
If any provision(s) of this Agreement is held by the arbitrators to
be contrary to law, then such provision(s) shall be construed, as nearly
as possible, to reflect the intentions of this Agreement with the other
provisions remaining in full force and effect.
ProPaidEmail.com's failure to excercise or enforce any right or provision
of this Agreement shall not constitute a waiver of such right or provision
unless acknowledged and expressly agreed to in writing by ProPaidEmail.com
